With reference to my report of the 21st of May, 1938,
on the subject of the exact position, as pointed out on 19th
May, 1938, of an alleged attack by Japanese on a sampan, I wish
to correct the impression which might be given by the
concluding words of that report. When I wrote it I thought
that the point at issue was whether the attack was in
Colonial waters or not and I considered that this was at
least doubtful. Although there was some divergence, say
within a quarter of a mile, between the positions pointed out
by the three witnesses, such a divergence would not be
material as regards territorial waters. In mentioning the
"attitude" of the witnesses I did not mean that they
indicated any doubt as to the occurrence or (within a quarter
of a mile) as to the exact position.
